Acceptance Of Terms

Please read these Terms of Use (“TOU”) carefully as they govern your access and use of this website (“Site”) and the products and services provided herein (“Service” or “Services”). These TOU are in addition to (not in lieu of) any specific terms and policies that apply to the Services you purchase or access through the Site, which terms and policies are incorporated herein by reference. The TOU and specific terms and policies referenced herein are collectively the “Agreement”.

As used herein, “Xinonic Digital”, “we”, “us”, “our”, and “ours” refers to Xinonic Digital together with its affiliates. “Customer”, “you”, “your”, and “yours” refers to the customer accessing this Site and purchasing and using the Services together with any company or other business entity you are representing, if any.

We reserve the right to make changes to the Site, the Services and these TOU at any time without prior notice to you. You should therefore review these TOU each time you access this Site to keep apprised of these changes. If you do not agree to the changes implemented by us, your sole and exclusive remedy is to terminate your relationship with us as a customer of the Services.

Our Obligation

A. Design Services, Process & Project

Xinonic Digital custom design service (the “Service”) provides businesses (each, a “Client”) the option to post assignments and project descriptions (each, a “Project”), including illustrative samples or other media (each, a “Creative Brief”), provide additional direction during the design process (each, a “Revision Brief”) and obtain responses (each, a “Response”) to those briefs from design experts retained by us.

Your Responses will be created iteratively through a drafting cycle of Creative Briefs, Revision Briefs and Responses, ultimately resulting in a final Response conforming to your various Creative and Revision Briefs (the “Final Product”).

B. Content

Xinonic Digital does not have a duty to screen or edit content but reserves the right to refuse service, monitor or remove any content for projects which are deemed illegal, misleading or obscene, or otherwise in breach of these TOU.

C. Ownership Rights of Artwork

Subject to your compliance with these TOU, you shall own the Final Product. However, you shall not own any materials or content generated during revision cycles leading up to the Final Product. Xinonic Digital retains the rights to all artwork concepts not selected by you.

D. Trademark, Service Mark & Copyright Clearance

You acknowledge that Xinonic Digital shall have no obligation to perform trademark, service mark or copyright clearance searches. Xinonic Digital shall have no responsibility to assist you in seeking intellectual property protection such as trademarks or copyrights for the Final Product. It is solely your responsibility to determine whether the design is legally available for use.

E. Collected Information, Privacy, Usage & Security

Xinonic Digital is committed to protecting your personal information. We collect information necessary to process your order and improve our services. While we strive to maintain secure systems, electronic transmission cannot be guaranteed to be completely secure.

Xinonic Digital may use your information for account creation, communication, updates, promotional offers and project notifications. Our representatives may contact you via email, phone or chat regarding your order or services.

Xinonic Digital uses secure payment servers and SSL encryption to ensure safe online transactions.

F. Confidentiality

Xinonic Digital strictly protects the confidentiality of client information. Personal information will not be sold or shared with third parties except when required to provide services or operate systems necessary for project management.

G. Unlimited Concepts

Packages offering unlimited concepts operate under a fair usage policy of up to 30 logo concepts. Initial sets may contain up to 15 concepts, while additional revision sets may contain 4 concepts per feedback cycle.

H. Satisfaction Guarantee

All design work goes through strict quality checks before delivery. Xinonic Digital offers unlimited revisions until the client is satisfied, provided that the selected design concept remains the same.

Your Obligations

I. Materials Provided by You

You may provide text, images, graphics, videos or other materials (“User Content”). You represent that you have the legal rights to provide this content and that it does not infringe upon any third party rights.

You grant Xinonic Digital a worldwide, royalty-free license to use such content in order to provide services.

J. Your Account, Password and Security

In order to purchase services, you must create an account and provide accurate billing and contact information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

Xinonic Digital may suspend or terminate your account if it is involved in violations of this Agreement.

K. Fees and Payments

You agree to pay all applicable service fees at the time of ordering. All payments are non-refundable unless otherwise stated. By submitting payment, you authorize Xinonic Digital to begin providing services immediately.

L. Additional Charges

• Rush delivery of samples
• Additional design concepts
• Changes after project completion
• Scope changes from the original project brief
• Complex third-party integrations

M. Delivery of Final Product

Final files will be delivered through the account area within 24 to 48 hours after approval. Delivered formats may include vector files, print-ready files, web-ready formats and source files depending on the project type.

N. Content Management System

Once login credentials are provided for the content management system, Xinonic Digital will not be responsible for any changes or errors made by the client.

O. Defamation

You agree not to publish defamatory or misleading statements regarding Xinonic Digital on any platform. Any issues must be addressed through our customer support team.

P. Conflict Resolution

Xinonic Digital will only address disputes submitted through official communication channels and not through third-party platforms.

Warranty

All services are provided “as is” without warranties of any kind, either expressed or implied.

Limitation Of Liability

Xinonic Digital shall not be liable for any indirect, incidental or consequential damages resulting from the use of our services or website.

Force Majeure

Xinonic Digital will not be responsible for delays caused by events beyond reasonable control such as natural disasters, internet outages or government restrictions.

Xinonic Digital provides phone, email and live chat support for customers regarding their projects and services.
